Update April 2022: The Ontario court has approved the Settlement Agreement. A copy of the Settlement Approval Order is posted here. The Settlement Class will be sent notice before June 29, 2022, advising on the claims process.


What are these Class Actions about?

The class actions relate to allegations that certain Nissan vehicles have a continuously variable transmission (“CVT”) that is defective, which can lead to poor transmission performance or failure. Nissan denies these allegations. The parties have agreed to the Settlement to avoid the cost and risk of further litigation.

The proposed Settlement is subject to court approval. The hearing to address approval of the Settlement is scheduled for March 31, 2022.  The settlement approval hearing will be held in-person at the Ontario Superior Court of Justice, Brampton Courthouse, located at 7755 Hurontario Street, Brampton, Ontario, or virtually, subject to the direction of the Court. If the hearing proceeds virtually, details for the hearing will be posted to this website in advance.

Who is included?

What benefits can I receive?

Settlement Class Members may be eligible for one or more of the following benefits, provided they meet certain requirements, if the Settlement is approved:

(1)    Warranty Extension: You may be eligible to have an extension of the time and mileage limits for powertrain coverage under your vehicle’s applicable New Vehicle Limited Warranty by 24 months or 40,000 kms, whichever occurs first, to the extent it applies to the transmission assembly (including the valve body and torque converter) and Automatic Transmission Control Unit.

(2)    Reimbursement for Replacement of or Repair to Transmission Assembly or ATCU: You may be eligible for reimbursement for parts and labour for qualifying repairs involving the replacement of or repair to the transmission assembly or ATCU within the time and mileage limits of the warranty extension.

(3)    Voucher Towards Purchase or Lease of a New Vehicle: You may be eligible for a Voucher in the amount of $1,300 for either a purchase or lease of a single new Nissan or Infiniti vehicle from an authorized Nissan dealer in Canada.

Exclude Yourself (Opt Out)

If you do not want to participate in the Settlement or be bound by it, you must exclude yourself by opting out. If you opt out, you will not be eligible to receive any benefits under the Settlement and you will not be able to object to the Settlement, but you will keep any right you have to separately sue Nissan at your own cost.

Object

If you are a Class Member and have comments about, or disagree with, any aspect of the Settlement that applies to you, you may express your views to the Court by submitting a personally signed written objection. You may object only if you do not exclude yourself from (i.e., opt out of) the Settlement.

Your objection must be mailed/couriered/emailed by March 4, 2022.
